 Supreme Court to take up pleas against military courts today

On Wednesday, Chief Justice of Pakistan (CJP) Umar Ata Bandial established a larger bench with nine members to hear petitions opposing the trial of civilians in military courts.

The petitions will be heard today (Thursday) at 11:45 a.m. by the larger bench that is headed by the chief justice.

In addition to CJP, the nine-member bench includes Senior Puisne Judge Justice Qazi Faiz Isa, Justice Sardar Tariq Masood, Justice Ijazul Ahsan, Justice Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Yahya Afridi, Justice Ayesha Malik, and Justice Mazahir Ali Naqvi. Also on the bench are Justices Ijazul Ahsan, Mansoor Ali

According to The News, a day earlier, former CJP Jawwad S Khawaja had submitted a petition to the Supreme Court challenging the use of military courts to try civilians.

He had submitted the petition in accordance with Article 184(3) of the Constitution, which included the law, defense secretaries, and provincial chief secretaries of the Federation of Pakistan as respondents.

The current petition, according to the former chief justice, does not seek to support or attack any political party or institution, but it does raise a significant constitutional issue involving fundamental rights that necessitates a decision in the present situation.

"The petitioner has no personal interest in this case, and the relief sought is for the benefit of all citizens regardless of political affiliation," Justice (retd.) Khawaja stated in the petition, which was submitted by his counsel, Khawaja Ahmad Hosain.

The former CJP requested that the Supreme Court rule that civilian court martials by military courts are unconstitutional when ordinary courts are in operation.

According to The News, lawyers Aitezaz Ahsan and Sardar Latif Khosa also called CJP Bandial on Tuesday to talk about important legal issues.

According to sources familiar with the situation, the senior lawyers briefed the CJP during an hour-long meeting about significant constitutional petitions filed in the apex court concerning the supremacy of the Constitution and citizens' fundamental rights in general.

In addition, it was discovered that Barrister Ahsan informed CJP Bandial of his constitutional petition opposing civilian trials in military courts and urged the chief justice to resolve the issue immediately in the Supreme Court.
